Buying a property in La Palma: 7. Ratification at the consulate

What happens if I am unable to attend the contract signing? Does this mean the property purchase has to be cancelled?

Volker Horch: No. In some cases, one of the parties is unable to be present at completion, and the process of drafting a power of attorney has not been initiated in time. In such situations, the deed of sale can initially be signed by only one of the parties before a Spanish notary in La Palma.

And what happens afterwards?

Volker Horch: The signed document is then sent electronically or in hard copy to the Spanish Consulate in the relevant country — wherever the other party is located — so that it can be formally ratified. The original document, once signed by both parties, is returned by post to the local notary who, upon receipt, authorises the release of funds.
