As our portfolio includes a significant number of building plots in the municipality of Los Llanos, we believe the following information is highly relevant for our clients.
The Supreme Court of Spain has declared the current General Urban Development Plan (PGO) of the municipality of Los Llanos de Aridane to be null and void. The legal framework on which the plan was based has been annulled (the full ruling can be consulted separately).
The current legal situation of the municipality, particularly with regard to planning and development rights, is not clearly defined. According to statements from the local council, efforts are being made to halt this judicial decision or at least mitigate its effects so that it does not impact the entire municipality. For the time being, the council maintains that the existing plan remains valid until the ruling is formally notified.
Once the ruling becomes final, the current plan will cease to have effect. From that point onwards, planning decisions would, in principle, revert to the previous General Urban Development Plan of 1987. However, this plan is not aligned with the Canary Islands Land Law of 2001, and it remains unclear to what extent planning decisions can be based on this older framework.
